Trump won Kentucky by 30 points — a special election is an automatic Republican win. But the Kentucky Constitution gives Gov. Beshear an untested power to appoint a Democrat instead. He must use it.

Mitch McConnell has been absent from the Senate since mid-June. What happens next comes down to one man: Governor Andy Beshear.

Kentucky Republicans rewrote the Senate vacancy law twice — over Beshear's veto both times — to make sure a Democratic governor could never fill this seat. McConnell personally recommended the first rewrite.

Their law demands a special election. In a state Trump carried by 30 points, that's not an election Democrats can win. But the Kentucky Constitution says the governor fills statewide vacancies by appointment. That power has never been tested against their law — and Beshear has already put every option on the table.

We're asking Governor Beshear to do three things: call no special election, assert his constitutional appointment power, and appoint a Democrat.

Republicans rewrote the rules twice because they feared exactly this moment. It's time to prove them right.
